Zero Tolerance – Operating While Intoxicated – Minor
Michigan’s “Zero Tolerance” law applies to drivers under the age of 21. Minors may not operate a motor vehicle with any bodily alcohol content (BAC). The law defines any bodily alcohol content as .02 or more, but less than .08. A minor with a BAC .08 or higher will presumably be charged with the same offense used on a driver who is over the age of 21.
A minor charged with a first offense Zero Tolerance violation face a maximum penalty of 360 hours of community services, a $250 fine, and driver license suspended for 30 days. A second offense within 7 years is punishable by up to 93 days in jail, community services, a $500 fine, and driver license suspended for 90 days.

Canada’s it is legal to drink at age 19. If a minor at the age of 19 or 20 has consumed alcohol in Canada, they can still be charged with a OWI Zero Tolerance offense in Michigan.
